Terms of Service

These Terms of Service ("Terms") govern your access to and use of QuitPouch's website (quitpouch.app), mobile applications, and related services (collectively, the "Service"), operated by QuitPouch ("QuitPouch," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this age requirement.

2. Description of the Service

QuitPouch is a self-tracking and support tool designed to help users log and monitor their nicotine pouch usage, set personal usage limits, and observe their own habits over time. QuitPouch is not a medical device, is not intended to diagnose, treat, cure, or prevent any disease or condition, and is not a substitute for professional medical or behavioral health advice.

QuitPouch does not guarantee that use of the Service will result in reduced nicotine use or cessation. Individual results vary. If you are seeking to quit nicotine or tobacco products, we encourage you to consult a licensed healthcare provider.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating an account and to keep it up to date.

4. Subscriptions and Billing

QuitPouch offers subscription plans billed on a recurring basis (monthly, and where offered, annually).
If you subscribe through the Apple App Store or Google Play Store, your subscription is billed and managed by Apple or Google in accordance with their respective terms. Billing, renewal, and cancellation are handled entirely through your Apple ID or Google Play account settings, not directly by QuitPouch.
Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date, through your Apple or Google account settings.
Refunds are subject to the refund policies of the Apple App Store or Google Play Store, as applicable. QuitPouch does not directly process refunds for app store purchases.
We reserve the right to change subscription pricing. If pricing changes, we will provide notice as required by the applicable app store's policies before the change takes effect for existing subscribers.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
Interfere with or disrupt the operation of the Service
Reverse engineer, decompile, or attempt to extract the source code of the app, except where permitted by law
Use automated means (bots, scrapers) to access the Service without our prior written consent

We reserve the right to suspend or terminate accounts that violate these Terms.

6. User Content and Data

You retain ownership of the usage data you log within the Service. By using the Service, you grant us a limited license to use this data as necessary to operate, maintain, and improve the Service, and as described in our Privacy Policy.

7. Intellectual Property

The Service, including its design, logos, text, graphics, and underlying technology, is owned by QuitPouch or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written permission.

8. Third-Party Services and Links

The Service may reference or link to third-party products, brands, or services, including nicotine pouch brands, for descriptive or comparative purposes only. Such references do not imply endorsement, sponsorship, or affiliation, and we are not responsible for the content, policies, or practices of any third-party service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SPECIFIC RESULTS WILL BE ACHIEVED FROM ITS USE, INCLUDING ANY REDUCTION IN NICOTINE USE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, QUITPOUCH AND ITS FOUNDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Medical Disclaimer

QuitPouch is not a healthcare provider. Nothing in the Service constitutes medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding nicotine use, dependence, or cessation, and before making any changes to your nicotine use based on information from the Service.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason, with or without notice, to the extent permitted by law.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law principles, unless otherwise required by applicable consumer protection law in your jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by updating the "Effective Date" above or through other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
